اثارت مصادقة تونس الى اتفاقية القضاء على جميع اشكال التمييز ضد المراة ” سيداو ” والمعتمدة من قبل الجمعية العامة للامم المتحدة الكثير من الجدل في تونس و قد يذهب البعض الى ان السبب وراء ذالك هو عدم الكشف بوضوح عن تفاصيل هذه الاتفاقية وكذا عن دواعي تونس الى المصادقة عليها او التحفظ عن بعض من بنودها .
ولكن وفي خطوة رسميّة جريئة مقارنة بدول المنطقة العربيّة ، قامت تونس بعد ثورة 14 جانفي بتبني المرسوم عدد 103 لسنة 2011 الصادر تاريخ 24 أكتوبر 2011 والمتعلّق بالترخيص في المصادقة على سحب بيان وتحفظات صادرة عن الحكومة التونسية وملحق بالقانون عدد 68 لسنة 1985 المؤرّخ في 12 جويلية 1985 المتعلّق بالمصادقة على اتفاقيّة القضاء على جميع أشكال التمييز ضدّ المرأة المعتمدة من قبل الجمعيّة العامّة للأمم المتحدة في 18 ديسمبر 1980،وطبقا للفصل الأوّل من هذا المرسوم ” تمّ الترخيص في المصادقة على سحب بيان الحكومة التونسيّة بشأن الفقرة الرابعة من المادة الخامسة عشر والتحفظات الصادرة عنها بِشأن اتفاقيّة القضاء على جميع أشكال التمييز ضدّ المرأة والمتعلّقة بالفقرة الثانية من المادّة التاسعة والفقرات ج، د، و، ز، ح من المادّة السادسة عشر والفقرة الأولى من المادّة التاسعة والعشرين.
كما ورد في الفصل الثاني من المرسوم عدد 103 لسنة 2011 أنّه على حكومة الجمهوريّة التونسيّة إيداع وثيقة سحب البيان والتحفظات المبيّنة بالفصل الأوّل أعلاه الملحقة بهذا المرسوم لدى الأمين العام للأمم المتحدة، ولكن لم يتمّ ذلك رسميا إلاّ في 17 أفريل 2014، وذلك مع إبقاء تونس على البيان العامّ الّذي أكّد على أنّ الحكومة التونسيّة لن تتّخذ أي قرار تنظيمي أو تشريعي طبقا لمقتضيات هذه الاتفاقيّة والذي من شأنه أن يخالف أحكام الفصل الأوّل من الدستور التونسي والّذي ينصّ على: ” ان تونس دولة حرّة، مستقلّة، ذات سيادة، الإسلام دينها، والعربية لغتها، والجمهوريّة نظامها”,و لا يجوز تعديل هذا الفصل.
وقد اعتبر البعض أنّ سحب تحفظات تونس يتعارض أصلا مع الفصل الأوّل من الدستور التونسي المؤرخ في 27 جانفي 2014 على اعتبار أنّ دين الدولة هو الإسلام، خصوصا الجانب المتعلّق بالمساواة في الميراث الّذي أثار جدلا كبيرا ولايزال إلى اليوم في مقدّمة المواضيع الّتي تهمّ الرأي العامّ التونسي.
ولكنّ المنطق القانوني يؤكّد أنّ الدين الإسلامي المنصوص عليه في الفصل الأوّل لا يعني أنّ الإسلام دين الدولة ،ولكن يراد منه أنّ الإسلام هو دين غالبيّة الشعب التونسي ،أي أنّه أريد منها التنصيص على التوجّه العامّ لمواطني الدولة دون الوصول إلى حدّ الإقرار بأسلمتها، وأبرز دليل على ذلك هو أنّ الفصل الثاني من الدستور أكّد على الطابع المدني للدولة، إضافة إلى تكريس الدستور لحريّة الضمير لأوّل مرّة في تاريخه.
فهذه الاتفاقيّة لا تتعارض بأيّ وجه مع نصّ الدستور في فصله الأوّل ،زيادة على كون الدستور يكرّس في فصله 21 المساواة بين الجنسين “المواطنين والمواطنات” أمام القانون، كما أنّ عديد النصوص الأخرى في الدستور تتّجه في هذا الاتجاه من خلال تكريس مبادئ أخرى تدعم المساواة بين المرأة والرجل مثل مبدأ التناصف ،وتنبذ كلّ أنواع التمييز الّتي دأب المجتمع في معناه الشامل يمارسها ضدّ المرأة.
وبالتالي لا يمكن الإقرار بعدم دستوريّة مشروع قانون المساواة في الميراث الّذي أقرّه المجلس الوزاري مؤخّرا في انتظار تداوله داخل مجلس نوّاب الشعب ،رغم معارضة الكثيرين له في نسخته الحاليّة. وحسب
رأي الخاصّ نحترم أن يكون المبدأ ما أقرّه التشريع الإسلامي في هذا المجال ،مع مراعاة واحترام رغبة أيّ شخص في اعتماد المساواة كاستثناء.
ولابدّ من الملاحظة أنّه تطبيقا لاتفاقيّة القضاء على جميع أشكال التمييز ضدّ المرأة أيضا قامت تونس بمقتضى قانــون أساسي عدد 46 لسنة 2015 مؤرّخ في 23 نوفمبر 2015 يتعلّق بتنقيح وإتمام القانون عدد 40 لسنة 1975 المؤرّخ في 14 ماي 1975 المتعلّق بجوازات السفر ووثائق السفر بتمكين المرأة مثلها في ذلك مثل الرجل الترخيص لابنها أو ابنتها القاصر قصد السفر ، كما يسمح لها بالسفر مع أولادها دون الحصول على إذن والد الطفل، ولقد اعتبرت منظمة هيومن رايتس تعليقا على هذا القانون على أنّ تونس تعمل
دستوريًا من أجل المساواة بين الجنسين.
ومن المنتظر حسب هذا التمشي إقرار تشاريع أخرى تطبيقا لهذه الاتفاقيّة بما أنّ الدول الأطراف مطالبة بتنسيق تشريعاتها الداخليّة على اختلافها مع موادّ الاتفاقيّة لتصبح متماشية معها ولا تتناقض مع أحكامها ،علما وأنّ الاتفاقيات المصادق عليها أقوى مرتبة من القانون بحكم الدستور ، كما أنّ الدستور الموجود في أعلى الهرم القانوني أي أنّه يعلو التشاريع الداخليّة والاتفاقيات الدوليّة المصادق عليها يتّبع نفس التمشي القاضي بتكريس المساواة بين الجنسين على جميع المستويات.

التحفظات التونسية على اتفاقية سيداو
تعلن حكومة تونس أﻧّﻬا لن تتخذ أيّ قرار تنظيمي أو تشريعي طبقًا لمقتضيات هذه الاتفاقيّة من شأنه أن يخالف أحكام الفصل الأوّل من الدستور التونسي. ـ الفقرة 2 من المادة 9 تبدي حكومة تونس تحفُّظًا بشأن الأحكام الواردة في الفقرة 2 من المادة 9 من الاتفاقيّة والّتي يجب ألاّ تتعارض مع أحكام الفصل السادس من قانون الجنسيّة التونسي. ـ الفقرات (ج) و (د) و (و) و (ز) و (ح) من المادة 16 تعتبر الحكومة التونسيّة نفسها غير ملزمة بالفقرات (ج) و (د) و (و) من المادّة 16 من الاتفاقيّة، كما تعلن أنّ الفقرتين (ز) و (ح) من نفس المادّة ينبغي ألاّ تتعارضا مع الأحكام الواردة في قانون الأحوال الشخصيّة بشأن منح لقب العائلة للأطفال واكتساب الملكيّة عن طريق الوراثة. ـ الفقرة 1 من المادّة 29 تعلن حكومة تونس، وفقا لمقتضيات الفقرة2 من المادّة 29 من هذه الاتفاقيّة، عدم التزامها بأحكام الفقرة 1 من تلك المادّة والّتي تنصّ على أنّ أي خلاف ينشأ بين دولتين أو أكثر من الدول الأطراف حول تفسير أو تطبيق هذه الاتفاقيّة ولا يُسَوّى عن طريق المفاوضات يجب أن يُحال إلى محكمة العدل الدوليّة، وذلك بناءا على طلب واحدة من هذه الدول. وتعتبر حكومة تونس أنّ مثل هذه الخلافات ينبغي ألا تعرض على التحكيم أو على محكمة العدل الدوليّة للنظر فيها إلاّ برضا جميع أطراف الخلاف. ـ إعلان بشأن الفقرة 4 من المادة 15 وفقًا لأحكام اتفاقيّة فيينّا لقانون المعاهدات المؤرّخة 23 ماي 1969 تؤكّد حكومة تونس أنّ مقتضيات الفقرة 4 من المادة 15 من اتفاقية القضاء على جميع أشكال التمييز ضدّ المرأة، وخاصّة منها ما يتعلّق بحق المرأة في اختيار مكان الإقامة ومحلّ السكنى، يجب ألاّ تُؤَوَّل على نحو مخالف لأحكام قانون الأحوال الشخصيّة ﺑﻬذا الخصوص والمنصوص عليها بالفصلين 23 و 61 من القانون“.
